Citation: Category IX - Consciousness on the Rail At approximately 11:05 AM Inspector was on the kill floor during slaughter. She observed a Holstein animal being stunned, shackled and hoisted. After the animal was stuck to bleed she noticed that the animal's sides were heaving (expanding and contracting) as if it was attempting to breathe and the upper and lower lips were quivering. The establishment employee took immediate corrective action and made multiple attempts to restun the animal. At this point I arrived on the kill floor. Inspector touched the cornea several times and the animal blinked while the lips continued to quiver. Mr. then shot the steer with a rifle which resulted in the animal becoming completely unconscious. This is a noncompliance with 9 CFR 313.15(a)(3) which states "immediately after the stunning blow is delivered the animals shall be in a state of complete unconsciousness and remain in this condition throughout shackling, sticking, and bleeding." A regulatory control action was taken in which USDA tag #B39600681 was applied to the kill chute as per 9 CFR 313.50(c). The tag will remain in place pending appropriate corrective actions.
Regulation:
313.15(a)(3) Immediately after the stunning blow is delivered the animals shall be in a state of complete unconsciousness and remain in this condition throughout shackling, sticking and bleeding.
313.50(c) If the cause of inhumane treatment is the result of improper stunning, the inspector shall attach a ‘‘U.S. Rejected’’ tag to the stunning area. Stunning procedures shall not be resumed until the inspector receives satisfactory assurances from the establishment operator that there will not be a recurrence. The tag shall not be removed by anyone other than an inspector. All livestock slaughtered prior to such tagging may be dressed, processed, or prepared under inspection.
