Citation: At 1400 hours while performing a scheduled 04B04 procedure the following noncompliance was noted pertaining to products observed in the Holding Cooler. 1) On a shelf against the wall on the left side as you enter the cooler are . These containers have no labels affixed onto the products or containers to determine their status as to whether the product in each container is "federally inspected" or "not for sale" product. There was one rack that did have "not for sale" products and those products were properly labeled. 2) In this same cooler are . All of these tubs and trays have written on a sheet of butcher paper the customer's name and weight of the product for each specific container. A couple of the containers were federally labeled properly. I brought , Plant Manager to the cooler to show him my findings and to answer my questions about the issues I had observed concerning these products. told me that all products in question are federally inspected and passed product and will be going back to the customer. also stated that "the way these products are labeled is the way they have always done the labeling here". I told this is in violation of 9 CFR 317.1(a), which states in part that "in an official establishment, any inspected and passed product is placed in any receptacle there shall be affixed to such container a label." All product was retained with USDA Tag #B8267265 pending proper labeling as described in 9 CFR 317.2. This noncompliance is being linked to NR #18 issued on 04/11/11 for improper labeling. Preventive measures were all products will be properly labeled through out all processes.

Regulation:

317.1(a) When, in an official establishment, any inspected and passed product is placed in any receptacle or covering constituting an immediate container, there shall be affixed to such container a label as described in §317.2 except that the following do not have to bear such a label.
