Citation: On April 12, 2011 at approximately 11:00 AM while touring the establishment with EAIO [redacted] and IIC [redacted] I observed the following noncompliances. 1) In the room that contains the "new" smokehouse, in the right hand corner as you walk through the door, there are tools, cords and miscellaneous materials in a heap along a 2 to 3 foot length of both walls where the corner intersects. 2) Along the back wall of the "new" smokehouse room there is a stack of boxes, pallets, and miscellaneous material. This pile extends most of the length of the back wall, is about 2 to 3 feet high and 2 to 3 feet wide. This stack of material is flush with the wall. 3) Along the left wall of the loading dock/storage area as you enter from the freezer hallway; there are pallets containing boxes of bags, spices, flour and other dry materials. These pallets are flush with the wall and it is not possible to see behind them. These are violations of 9 CFR 416.1 which states in part that "Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions" and 9 CFR 416.2(a) which states that facilities must be maintained to prevent conditions which could "interfere with inspection by FSIS program employees." In the loading dock/storage area in the new addition part of the establishment the following noncompliance was found. The man door next to the garage door has not yet been installed. There is blue insulation material covering the opening. There is a 2 to 3 inch gap at the bottom of the door which leads to the outside. This is a violation of 9 CFR 416.2(b)(3) which states that "Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice." In the hallway leading from the cut up room to the freezer the following noncompliance was found. Along the left wall of the hallway as you enter from the cut up room, there are grey tubs that are painted at the top with reddish paint. These tubs contain various sizes of plastic bags used for vacuum packaging product. The tubs are labeled with numbers written on masking tape. In tubs labeled 10-13, 8-10, 6-20 and 8-15 there are pieces of dried product residue and dirt. This is in violation of 416.3(a) which states in part that "Equipment and utensils must be maintained in sanitary condition so as not to adulterate product" and 9 CFR 416.4(b) which states "Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product." Mr. was notified of these noncompliances.
Regulation:
416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.
416.2(a) Grounds and pest control. The grounds about an establishment must be maintained to prevent conditions that could lead to insanitary conditions, adulteration of product, or interfere with inspection by FSIS program employees. Establishments must have in place a pest management program to prevent the harborage and breeding of pests on the grounds and within establishment facilities. Pest control substances used must be safe and effective under the conditions of use and not be applied or stored in a manner that will result in the adulteration of product or the creation of insanitary conditions.
416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.
416.3(a) Equipment and utensils used for processing or otherwise handling edible product or ingredients must be of such material and construction to facilitate thorough cleaning and to ensure that their use will not cause the adulteration of product during processing, handling, or storage. Equipment and utensils must be maintained in sanitary condition so as not to adulterate product.
416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
