Citation: At approximately 10:45am while performing an unscheduled 04C02 to verify the humane handling requirements Dr. noticed the following non-compliance. Pen #2, which was in disrepair, had 1 lamb inside the pen. The gate leading from the pen to the alley to the kill chute was boarded shut because the establishment was not going to use the pen until it is repaired. The front gate latch is broken and the gate was open. There are 2 bolts sticking out of a worn board between Pens #1 and #2 which could injure the animals in the pen. Retain tag #B30456764 was applied to the front gate of pen #2 and Mr. was notified of the non-compliance. He immediately moved the lamb to another pen. This non-compliance is a violation of 9 CFR 313.1(a) which states in part that, "Livestock pens, driveways and ramps shall be maintained in good repair. They shall be free from sharp or protruding objects which may, in the opinion of the inspector, cause injury or pain to the animals." Regulation:
313.1(a) Livestock pens, driveways and ramps shall be maintained in good repair. They shall be free from sharp or protruding objects which may, in the opinion of the inspector, cause injury or pain to the animals. Loose boards, splintered or broken planking, and unnecessary openings where the head, feet, or legs of an animal may be injured shall be repaired.
