Citation: At approximately 1:40 pm while performing a cooler check I found the following non-compliance in the chill cooler off the processing room. One carcass half marked not for sale was adjacent to an inspected carcass half. The halves were in contact with one another at the shoulder and the hip areas such that the shoulder of the "not for sale" carcass was pressed against the shoulder of the inspected carcass and the hip of the "not for sale" carcass was pressed against the hip of the inspected carcass. Mr. was informed of this non-compliance. He then split the custom carcass half into quarters. He removed the brands from the inspected product and split that half into quarters to be treated as custom product. This non-compliance is a failure to follow 9CFR 303.1(a)(2)(ii) which states, "If the custom operator prepares or handles any products for sale, they are kept separate and apart from the custom perpared products at all times while the latter are in his custody." Past Similar NRs - Previous Ineffective Plant Actions: Custom product will be moved to separate cooler by Nov. 30, 2010. Until that time management will check daily to verify custom separate from inspected

Regulation:

303.1(a)(2)(ii) If the custom operator prepares or handles any products for sale, they are kept separate and apart from the custom prepared products at all times while the latter are in his custody;
