Citation: At approximately 1345 I observed the following non-compliance. While performing a temperature verification check on raw ground product I observed the temperature of the ground beef to be at 50 degrees Fahrenheit in a grey tote of product that was almost completely packaged. I informed of the non-compliance for the failure to keep product under the critical limit of degrees Fahrenheit. I then began to check the rest of the lot to ensure that the critical limit had not been reached or passed and all of grey totes that I checked were at 50 degrees Fahrenheit. I then took a regulatory control action and tagged the 3 carts with the 11 grey totes of ground product using U.S. Retain tags NO. B39878909, NO. B39878910 and NO. B39878911. I told that their corrective actions per the establishments HACCP plan was to "[redacted]." He then proceeded to grind the rest of the ground product out of the grinder and placed all 3 carts with the 11 grey totes into the freezer. The product was moved from the freezer to the cooler because it is going to be left in the cooler overnight since it was close to the end of the shift and because the product requires inspection and there was not enough time to have the product brought down to an acceptable temperature and for it to be packaged. This document serves as notice of non-compliance with in Federal Regulations 9 CFR 417.2(c)(4) and 417.2(c)(5).


417.2(c)(4) List the procedures, and the frequency with which those procedures will be performed, that will be used to monitor each of the critical control points to ensure compliance with the critical limits;

417.2(c)(5) Include all corrective actions that have been developed in accordance with 417.3(a) of this part, to be followed in response to any deviation from a critical limit at a critical control point;
