Citation: At approximately 0634 hours, while performing a 04C04 ISP Code procedure for AQL Inspection for Giblets and Necks. I randomly selected ten poultry necks from a stainless steel tank of poultry necks; I found one neck out of ten had fecal materials on outside surface of the neck approximately 2mm in size. The fecal material was light greenish in color, semi-solid, thick pasty consistency. I immediately took a regulatory control action of the tank of poultry necks with US Retained Tag B 39 133535. I informed (Quality Assurance Manager) of my finding. I relinquished my regulatory control action on the tank of poultry neck, after the plants immediate corrective action according to the regulatory requirements of 417.3 was put in place. Establishment management condemned all affected product. If I had not observed the visible fecal material on the poultry neck, when I performed this test, therefore it is reasonable to assume the contaminated neck would have entered the tank chiller in violation of regulation 381.65(e). The poultry necks are placed into in a stainless steel tank for chilling in the packing department. The establishment has [redacted] Establishment HACCP Plan do not identified AQL Inspection for Giblets and Necks to be a hazard in it hazard analysis and should comply with 9 CFR 417.3 (b)(4). Fecal material harbors microorganisms and possible pathogens and must be prevented from entering into the chill system. I performed a 03J02 procedure for the 03J01 noncompliance for Lot #1. Establishment management has received oral and written communication concerning this noncompliance. This document serves as a written notification that failure to comply with these regulatory requirements could result in further enforcement action.

Regulation:

381.65(e) Poultry carcasses contaminated with visible fecal material shall be prevented from entering the chilling tank.

417.2(c)(4) List the procedures, and the frequency with which those procedures will be performed, that will be used to monitor each of the critical control points to ensure compliance with the critical limits;
