Citation: At 0800 hours, while performing 06D01 (Facility ) with Mr. (FLS), Dr. (PHV, IIC) and Mr. (SCSI), we observed the following noncompliances: Condensation was observed on the top surface of the box track entering the Whole Bird cooler. Inside the cooler we observed water dripping from the seams in the plastic (which was hung on the ceiling) onto a skid of bagged ice and also a stack of box lids. I notified Mr. (Second Processing Supervisor) of the noncompliance. I took regulatory control and rejected the box track by applying U.S. Reject tag # B39801791 and the cooler with U.S. Reject tag # B39801781. In the tray Pack room we observed ceiling tiles out of place and dirty overhead piping. In the shipping cooler we observed frozen condensation on pipes at the cooling units and the steel curbing was free from the wall with black U.F.M. build-up behind the steel. The walls and door frame had a dark brown build-up and a stack of skids were observed to have dirt and other U.F.M. build-up on them. On the shipping dock a shipping trailer which was being used for storage of product was found unacceptable with black build-up on the door and walls of the trailer and rain water was leaking from the dock seal. I rejected the trailer with U.S. Reject tag # B 39801756. The metal frame on the door between shipping dock area and the tray pack area is broken away from the wall and the white pipes on the shipping dock have a build -up on the top surfaces. In the Fresh for Freezer and white meat debone area condensation was observed dripping from a white pipe for the cooling unit drip pan and the drip pan for the unit was too short to cover the unit. In the Tote Wash room condensation and leaks in the ceiling were observed. Water was observed dripping on a skid of washed tote lids, and we rejected the area with U.S. reject tag # B 39801768 and Tag # B 39801757. At 0945 hours, I inspected and released the tote room to production after plastic had been hung to protect the clean totes. At 1000 hours Mr. (Plant Manager) presented to USDA a letter outlining the establishment's corrective action plan for the permanent corrective measures to repair the Whole Bird cooler ceiling, at which time I inspected the whole bird cooler and released it to production. Mr. (Shipping Supervisor) requested that I inspect the holding trailer which had been emptied and cleaned. I found the holding trailer acceptable and released the trailer at 1220 hours. Mr. and Mr. were notified that a NR would be issued for these noncompliances. Plant Management has been notified both orally and in writing about these noncompliances. Plant management was informed in weekly meetings to do something about controlling condensation in the Whole Bird cooler, documented in MOI for 06/25/10 and 07/14/10. Past Similar NR's - Previous preventive measures were either not implemented or were ineffective in preventing the recurrence of this noncompliance. Please refer to NR 0078-2010-17446 dated 07/08/2010. This document serves as written notification that failure to comply with regulatory requirements could result in additional enforcement as described in 9 CFR part 500.

Regulation:

416.2(b)(1) Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.

416.2(d) Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
