Violation: 416.13(c), 416.3(a), 416.4(a), 416.4(d)

Citation: On 7/1/2010, at approximately 0700 hours, I observed the neck chutes in the evisceration department were full and the necks were not properly flowing down the pipes into the neck chiller. Two maintenance employees were attempting to unclog the neck chutes. One employee took a long metal hook that was hanging on an overhead metal pipe and yellow cable (non-product contact surfaces) near the wall and used the hook to unclog the neck chutes. I immediately notified Evisceration Supervisor, of the noncompliance and that a NR would be issued. As I was applying a U.S. Rejected tag to the hooks, one maintenance employee removed the hook for cleaning and stated he would devise a product-contact holder for the pipe. I then notified , QA Manager, of the noncompliance and that the necks, neck chutes, pipe, and chiller were contaminated. Mr. and I discussed the establishment's antimicrobial system and QA performed additional monitoring to determine the necks were not adversely affected. Establishment management have received oral and written communication concerning this noncompliance. Past Similar NRs - Previous Ineffective Plant Actions: See plant response to NR: 61-2010 dated 6/1/2010. The previous preventive measure was either not implemented or was ineffective in preventing the recurrence of this noncompliance (product contact utensils stored on non-product contact surfaces). Failure to meet regulatory requirements could result in additional enforcement action as described in 9 CFR 500.

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.3(a) Equipment and utensils used for processing or otherwise handling edible product or ingredients must be of such material and construction to facilitate thorough cleaning and to ensure that their use will not cause the adulteration of product during processing, handling, or storage. Equipment and utensils must be maintained in sanitary condition so as not to adulterate product.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
