Citation: On 6/28/2010, at approximately 1445 hours, I observed the water in the toilet and in the hand wash sink in the USDA bathroom was brown-black in color. I immediately notified , Maintenance Manager, of the noncompliance and stated I would check the water throughout the establishment. CSI and I filled clean, white buckets with water from different areas of the establishment. The following describes our observations and regulatory control actions: -Water at the evisceration hand wash sinks near the salvage stations contained black specs, too numerous to count, ranging in size from pinpoint to 3 mm. The sinks were tagged with U.S. Rejected tag No. B38670046 at 1449 hours. -Water in the toilets and in the sinks in the evisceration women's bathroom was brown-black in color and contained black specs, too numerous to count, ranging in size from pinpoint to 3 mm. The evisceration women's bathroom was tagged with U.S. Rejected tag No. B38670043 at 1454 hours. -Water in the toilets and in the sinks in the evisceration men's bathroom was brown-black in color and contained black specs, too numerous to count, ranging in size from pinpoint to 3 mm. The evisceration men's bathroom was tagged with U.S. Rejected tag No. B38670044 at 1456 hours. -Water in the toilet and in the sink in the USDA bathroom was brown-black in color and contained black specs, too numerous to count, ranging in size from pinpoint to 3 mm. The USDA bathroom was tagged with U.S. Rejected tag No. B38670046 at 1458 hours. -Water at the cut up department's hand wash sinks contained black specs, too numerous to count, ranging in size from pinpoint to 3 mm. The sinks were tagged with U.S. Rejected tag No. B39801794 at 1505 hours. -Water used for production and on product contact surfaces appeared acceptable. Water in the basement employee bathrooms appeared acceptable. Water at other hand wash sinks in different departments (i.e., live hang, breast debone, etc.) appeared acceptable. A member of management and/or a member of maintenance was present for each water check and regulatory control action. Various members of management were informed, including (Maintenance Manager), (Director of QA), (Evisceration Supervisor), and (Evisceration Group Lead). After the establishment implemented corrective actions to remove black specs and discoloration, all regulatory control actions (tags) were released between 1510 and 1528 hours. Establishment management have received oral and written communication concerning this noncompliance. Failure to meet regulatory requirements could result in additional enforcement action as described in 9 CFR 500.

Regulation:

416.2(e)(3) Prevent adulteration of product, water supplies, equipment, and utensils and prevent the creation of insanitary conditions throughout the establishment;

416.2(h)(1) Dressing rooms, toilet rooms, and urinals must be sufficient in number, ample in size, conveniently located, and maintained in a sanitary condition and in good repair at all times to ensure cleanliness of all persons handling any product. They must be separate from the rooms and compartments in which products are processed, stored, or handled.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
