Citation: On this day prior to the start of establishment operations, but after plant monitor performed their own check, USDA Inspection performed a pre-operational verification procedure. Non compliance was observed as follows on the gizzard cutting/cleaning apparatus; on the underside of the metal guard prior to the blade there was residue buildup (from previous operations) of approximately 6 inches square, on the internal framework of the opening machine there was residue and connective tissue buildup (from previous operations) at 3 separate locations, on the gizzard defatter the rubber gasket/seal did not appear to be removed for cleaning as there was residue on the bottom side and small stones (normally found in gizzards of birds) that were too numerous to count. US Reject Tag #B24107555 was affixed to the area. Upon reinspection approximately 7 minutes later the following was observed; residue on the underside of the metal guard was still present on an area of approximately 2 square inches, residue and connective tissue on the inner framework was still in 2 of the 3 locations identified to the plant monitor, and the defatter still had residue under approximately 1/10th of the gasket. Establishment employees took additional corrective actions in the presence of Inspection, equipment was checked for a third time and was found acceptable. Observations by Inspection represent a failure of the establishment to meet the requirements of 9 CFR 416.1 which states "Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.", 9 CFR 416.13(c) which states "Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP's.", 9 CFR 416.4(a) which states "All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.", and 9 CFR 416.4(b) which states "Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product." was informed of this non-compliance with regulations verbally and was informed in writing with the issuance of this Non-compliance Report. Past Similar NRs - Previous Ineffective Plant Actions: establishment has not yet responded in writing to this non-compliance NR: 13-2011 dated 9/15/2011

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
