Violation: 381.76(b)

Citation: At approximately 0600 on 5/22/12, (Evisceration Supervisor) informed me that the Maestro tech had come the previous evening and she would like me to come down and look at the east line. The tech was working on the line after previous presentation failures. I went down to evisceration and began a presentation check at 0620. The east one inspection station failed with a score of 51 at 0624. This includes the following errors: 1 contamination outside (6 points); 1 parts inside (1 point); 4 contamination inside (24 points total); and 1 no viscera (20 points). The line speed was immediately reduced to [redacted] birds per minute (bpm). QA performed a retest between 0631 and 0637 and got passing scores of [redacted] and [redacted] for the first, second, and third stands respectively at a speed of [redacted] bpm. They raised the line speed to [redacted] bpm and did another retest between 0639 and 0643 and got passing scores of [redacted], and [redacted] for the first, second, and third stands respectively. While QA was performing their retests, at 0632 hours, CSI who was giving breaks at the east third inspection stand, noticed that 4 birds in a row were lined up with the grey trays instead of the white trays which belong to the third inspection station. The birds were centered over the incorrect (grey) trays. The birds and trays then gradually corrected themselves but then began to move toward the blue trays and remained between the white and blue trays as several birds passed the station. He stopped the line and rang the bell to inform management. The line was stopped for approximately 30 seconds. The establishment placed an employee on the line to realign the birds with the correct tray. An employee had been in place earlier in the day, and yesterday, to align the birds and trays. This person was taken off after the 0620 presentation checks. The establishment placed people on the East two and East three stands, next to the inspection stands, as part of the corrective actions for the NR number YVB0812053517N/1 dated 5/17/12. This noncompliance is a failure to comply with 9CFR 381.76(b). This NR is linked to NR YVB3112050818N/1 dated 5/18/12. This document serves as written notification that further failure to comply with regulatory requiremnts may lead to additional administrative action.

Regulation:

381.76(b) Presentation: Each inspector shall be flanked by an establishment employee assigned to be the inspector’s helper. The one inspector on the SIS–1 line shall be presented every bird. Each inspector on the SIS–2 line shall be presented every other bird on the line. An establishment employee shall present each bird to the inspector properly eviscerated with the back side toward the inspector and the viscera uniformly trailing or leading. Each inspector shall inspect the inside, viscera, and outside of all birds presented.
