Citation: At approximately 23:30 on 11/08/11 while revisiting plant for overtime coverage I took note of [redacted] (night shift supervisor) taking a skid with 5 cases from the trailer. The five cased did not have the any label identifying the product or the mark of inspection showing that the product was inspected. After questioning the supervisor about what the product was and what his intentions were he informed me that the product was pheasants and that he was going to label the product. I ask him to show me the label that he was to apply to this product. The label he show me was a label with Pheasant as the name with the mark of inspection. At this time I informed him that I was retaining the product with a US retain tag. Product was being retained until more information was provided about these five cases of pheasants.

Regulation:

312.2 (a) The official inspection legend required by part 316 of this subchapter to be applied to inspected and passed carcasses and parts of carcasses of cattle, sheep, swine and goats, meat food products in animal casings, and other products as approved by the Administrator, shall be in the appropriate form as hereinafter specified: 1 For application to sheep carcasses, the loins and ribs of pork, beef tails, and the smaller varieties of sausage and meat food products in animal casings. For application to calf and goat carcasses and on the larger varieties of sausage and meat food products in animal casings. For application to beef and hog carcasses primal parts and cuts therefrom, beef livers, beef tongues, beef hearts, and smoked meats not in casings. For application to burlap, muslin, cheesecloth, heavy paper, or other acceptable material that encloses carcasses or parts of carcasses.

317.1(a) When, in an official establishment, any inspected and passed product is placed in any receptacle or covering constituting an immediate container, there shall be affixed to such container a label as described in 317.2 except that the following do not have to bear such a label.
