Citation: On 8/25/2011, at approximately 1100 hours, while Dr. and I were performing an unscheduled 04B04 we observed the following: The label on the immediate container of packaged Young Organic Turkey Breast failed to bear the net weight . We then inspected the label on the shipping container for the product as the immediate container does not need to bear the net weight if the shipping container bears the statement " Net weight to be marked on consumer packages prior to display and sale" and the total net weight of the contents is on the shipping container and the shipping container bears the statement, " Tare weight of consumer package" followed by the tare weight. The shipping container for the above product did bear the total net weight but did not have the required statements. We also reviewed the label for product being produced on the tray pack line, chicken legs" and observed the same non-compliance. We took a regulatory control action by placing tag number B34802789 on the shipping department. The establishment failed to comply with 9 CFR 381.121(a).

Regulation:

381.121(a) The label shall bear a statement of the quantity of contents in terms of weight or measures as provided in paragraph (c)(5) of this section. However, the Administrator may approve the use of labels for certain types of consumer packages which do not bear a statement of the net weight that would otherwise be required under this subparagraph: Provided, That the shipping container bears a statement ‘‘Net weight to be marked on consumer packages prior to display and sale’’: And provided further, That the total net weight of the contents of the shipping container is marked on such container: And provided further, That the shipping container bears a statement ‘‘Tare weight of consumer package’’ and in close proximity thereto, the actual tare weight (weight of packaging material), weighed to the nearest one-eighth ounce or less, of the individual consumer package in the shipping container. The above-specified statements may be added to approved shipping container labels upon approval by the inspector in charge.
