Citation: At approximately 0920 hours, Dr. [redacted] and I were walking in the bagged bird area and observed the following: The plant employees were removing the packing from bird (the birds were packed as frozen, whole Pollo Rosso). On closer examination, we found that there were no dates on the bagged birds. There were 2 cases in the bagged bird room, 10 birds to a case. [redacted], 2nd processing manager, said that there is a skid in the freezer of these birds. He said he had removed the birds from the cases the day before (2 cases- 20 birds), put them in a gray barrel to thaw, and put the labels from the cases on the gray barrel. Dr. [redacted] and I then checked the partial skid from the freezer. There were 14 cases (10 birds in each case) with no dates, no lot number which was the number of the day of the year the poultry was slaughter and no coded number on the bagged birds. I asked Mr. [redacted] and the Q. C. technician if there was a date. They were unable to show me a lot number or code on the immediate container. Mr. [redacted] HACCP Manager and Mr. [redacted] were verbally notified along with the Q. C. Tech. [redacted] of the non-compliance. Regulatory control tag number B-24785729 was placed on the 16 cases (10 birds in each case). 9 CFR 381.126(b) requires the immediate containers of dressed poultry to marked with a lot number which shall be the number of the day of the year on which the poultry was slaughtered or a coded number. Regulation:

381.126(b) The immediate container for dressed poultry shall be marked with a lot number which shall be the number of the day of the year on which the poultry was slaughtered or a coded number.
