Violation: 416.13(c), 416.4(a), 416.4(d)

Citation: At approximately 0840 hrs.while standing at the Inspection station I observed an employee enter the department thru the door at the transfer belt that leads to the kill floor area. The employee took a chicken off the belt and return to the kill floor area with the chicken . The employee had his kill floor frock and apron on which had feathers and blood on them. I immediately stopped the evisceration line and informed Mr. [redacted] department supervisor of the non -compliance. The week of 03-10-11 I discussed my concerns for this issue at the weekly meeting with the plant's management, Mr. [redacted] Production Manager/HACCP Coordinator & Mr. [redacted] Consultant presence. CSI [redacted] was also in the USDA office at the time of the meeting and commented that she saw an employee enter the department thru the same door and take a chicken back to the kill floor area, while on the line reliving me for my break. The plant is not meeting 9 CFR 416.13(c), 416.4(a) and 416.4(d). Past Similar NRs - Previous Ineffective Plant Actions: NR # 0012 - 2011- 17310 is unanswered at this time NR: 12-2011 dated 3/22/2011 This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOPís.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
