Citation: At approximately 01250 hrs. while entering the women's bathroom I observed in the first stall water on the floor surrounding the commode. The commode had been used and was not flushed. The next stall had soiled toilet paper on the seat of the commode and was not flushed ,there was toilet paper laying all over the floor in the room. I immediately applied USDA Retain /Reject # B34 802517.to the door of the bathroom I informed Mr. [redacted] that the bathroom cannot be used I asked Mr. [redacted] to check the men's bathroom which was found acceptable. Mr. [redacted] took immediate corrective action by instructing an employee to clean the bathroom after sanitary condition were restored , regulatory control action was relinquished. The plant is not meeting 9 CFR 416.2(h) & 416.5(a).

Regulation:

416.2(h) Dressing rooms, lavatories, and toilets. Dressing rooms, toilet rooms, and urinals must be sufficient in number, ample in size, conveniently located, and maintained in a sanitary condition and in good repair at all times to ensure cleanliness of all persons handling any product. They must be separate from the rooms and compartments in which products are processed, stored, or handled.

416.5(a) Cleanliness. All persons working in contact with product, food-contact surfaces, and product-packaging materials must adhere to hygienic practices while on duty to prevent adulteration of product and the creation of insanitary conditions.
