Citation: At approximately at 0625 hours, I was conducting a walkthrough of the Upper Freezer in Plant 1 with Inspector [redacted] and the following noncompliances were observed. We observed ice and frost buildup on most the freezer walls, floors and throughout the freezer ceiling. Some of the ice buildup on the ceiling and walls looked like stalactite formations that ranged from 2 inches to 6 inches long by 1/2 inch to 3 inches wide. Approximately 65 percent of the ceiling also had a thick layer of frost that I observed falling to the floor and boxes. I also observed 3 boxes with the lids not properly closed. All around the freezer floor we observed solid ice accumulation, and at the back of the freezer, the corners held an extensive accumulation of ice which prevented us from properly inspecting this area. At the aforementioned back of the freezer, the ice covered all the floor around the right and left evaporator units forming a solid sheet that extended approximately 4 feet toward the front. In some areas the ice formed stalagmites shapes which projected from the floor approximately 2 to 6 inches high. We also observed near the entrance of the freezer some areas with what appeared to be an accumulation of blood on the ice and also dirty ice and wood pieces were also observed. At approximately 0745 hours after Inspector [redacted] and I finished giving breaks to the line inspectors, we informed and showed [redacted] (General Production Manager) all the deficiencies found and described in this noncompliance record. This is a failure to comply with Meat and Poultry regulatory requirement 9 CFR 416.3(b), 416.2(b)(2), 416.2(d) and 416.1.


416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

416.3(b) Equipment and utensils must not be constructed, located, or operated in a manner that prevents FSIS inspection program employees from inspecting the equipment or utensils to determine whether they are in sanitary condition.
