Citation: On July 06, 2011 at approximately 0940 hours, I & Dr. [redacted] saw a small cockroach about 1.5 cm. length on the exterior of the USDA office door in the 2nd. Floor. I kept the cockroach & showed it to [redacted] the establishment QC personnel. You are in violation of 9 CFR 416.1, which states " Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated". And also 416.2(a), which states " Establishments must have in place a pest management program to prevent the harborage and breeding of pests on the grounds and within establishment facilities. Pest control substances used must be safe and effective under the conditions of use and not be applied or stored in a manner that will result in the adulteration of product or the creation of insanitary conditions". This noncompliance is linked to a previous non compliance of a similar cause, record # 0032-2011-16459, dated 06/21/2011. Previous preventive measures were ineffective or were improperly implemented to prevent recurrence. This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(a) Grounds and pest control. The grounds about an establishment must be maintained to prevent conditions that could lead to insanitary conditions, adulteration of product, or interfere with inspection by FSIS program employees. Establishments must have in place a pest management program to prevent the harborage and breeding of pests on the grounds and within establishment facilities. Pest control substances used must be safe and effective under the conditions of use and not be applied or stored in a manner that will result in the adulteration of product or the creation of insanitary conditions.
