Violation: 416.15(a), 416.15(b), 416.16(a)

Citation: On 31 August 2010, at approximately 1305 hrs, whilst performing a scheduled ISP procedure code 01B01, a review of the "Pre-op SSOP Record", otherwise known as USA-SSOP-FORM-001, dated 30 August 2010, was performed and the following noncompliances were identified: The large scald tank, moving table, rollers & sticks, conveyor, and skinner (five items/areas on the kill floor or in the cut room) were rejected as being unsanitary by [redacted] QC and [redacted] QC. However, for all five of the aforementioned items/areas, no explanation of the deficiency was documented; additionally, no documentation of the SSOP corrective actions was performed. Lastly, no reinspection of these five items/areas was annotated on this form. [redacted] QC, was notified of the noncompliance by approximately 1320 hrs. No regulatory control action was taken as no product was directly affected. The establishment is not in compliance with the following regulations: 9 CFR 416.15(a), which states the following: "Each official establishment shall take appropriate corrective action(s) when either the establishment or FSIS determines that the establishment's Sanitation SOP's or the procedures specified therein, or the implementation or maintenance of the Sanitation SOP's, may have failed to prevent direct contamination or adulteration of product(s)."; 9 CFR 416.15(b), which states the following: "Corrective actions include procedures to ensure appropriate disposition of product(s) that may be contaminated, restore sanitary conditions, and prevent the recurrence of direct contamination or adulteration of product(s), including appropriate reevaluation and modification of the Sanitation SOP's and the procedures specified therein or appropriate improvements in the execution of the Sanitation SOP's or the procedures specified therein."; 9 CFR 416.16(a), which states the following: ""Each official establishment shall maintain daily records sufficient to document the implementation and monitoring of the Sanitation SOP's and any corrective actions taken. The establishment employee(s) specified in the Sanitation SOP's as being responsible for the implementation and monitoring of the procedure(s) specified in the Sanitation SOP's shall authenticate these records with his or her initials and the date." Please be forewarned that this establishment is under an NOIE. Records MUST be complete, accurate, and reflect plant conditions.

Regulation:

416.15(a) Each official establishment shall take appropriate corrective action(s) when either the establishment or FSIS determines that the establishmentís Sanitation SOPís or the procedures specified therein, or the implementation or maintenance of the Sanitation SOPís, may have failed to prevent direct contamination or adulteration of product(s).

416.15(b) Corrective actions include procedures to ensure appropriate disposition of product(s) that may be contaminated, restore sanitary conditions, and prevent the recurrence of direct contamination or adulteration of product( s), including appropriate reevaluation and modification of the Sanitation SOPís and the procedures specified therein or appropriate improvements in the execution of the Sanitation SOPís or the procedures specified therein.

416.16(a) Each official establishment shall maintain daily records sufficient to document the implementation and monitoring of the Sanitation SOPís and any corrective actions taken. The establishment employee(s) specified in the Sanitation SOPís as being responsible for the implementation and monitoring of the procedure(s) specified in the Sanitation SOPís shall authenticate these records with his or her initials and the date.
