Citation: ***HAT CATEGORY III--WATER AVAILABILITY*** On 24 August 2010, at approximately 1105 hrs, whilst performing an unscheduled ISP procedure code 04C02, I performed a Humane Activity Tracking (HAT) verification of water availability and observed the following noncompliance: In the offloading area of the pens, four disabled/nonambulatory market swine were lying in the left side of this area near to the gate leading to the pens and scale; these swine had no access to water. I took immediate regulatory control action and affixed US Rejected/US Retained tag number B37728042 to the back wall of this area. [redacted] Jr, was notified of this noncompliance by approximately 1107 hrs. He turned on a tap in the area, allowing water to course down a hose placed near the aforementioned swine. Following Mr [redacted] actions, at approximately 1108 hrs, the US Rejected/US Retained tag was removed and the area was released. The establishment is not in compliance with the following regulation: 9 CFR 313.2(e), which states, in part, the following: "Animals shall have access to water in all holding pens and, if held longer than 24 hours, access to feed...".

Regulation:

313.2(e) Animals shall have access to water in all holding pens and, if held longer than 24 hours, access to feed. There shall be sufficient room in the holding pen for animals held overnight to lie down.
