Citation: On 12 July 2010, at approximately 1317 hrs, whilst performing an unscheduled ISP procedure code 06D01 (Facilities & Equipment), the following noncompliance was observed in the middle cooler: The clear, plastic wrap under the cooling unit [redacted] along the west wall of this aforementioned cooler, this material being used to contain condensate originating from this cooling unit, was discovered to be perforated and dripping to the floor beneath. No product was in the general vicinity and, therefore, no product was directly affected. I took immediate regulatory control action and affixed US Rejected/US Retained tag number B43736053 to this cooling unit. QC, was notified of this noncompliance by approximately 1320 hrs. The establishment is not in compliance with the following regulations: 9 CFR 416.1, which states the following: "Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated."; 9 CFR 416.2(d), which states the following: "Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided." This noncompliance is linked to a noncompliance of similar cause, Record Number 0026-2010-17285, dated 17 May 2010. This document serves as written notification that your failure to comply with these regulatory requirements could result in additional regulatory or administrative action.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.
