Citation: HATS Category III - Water and Feed Availability On Monday, August 22, 2011 at approx. 0845 hours while performing Inspection System Procedure (ISP) 04C02, HAT procedure "Water and Feed Availability" observed the following noncompliance with "Water and Feed Availability", 9 CFR 313.2(e). Observed live animals (Hogs) in several livestock pens and the livestock unloading area without water. Three livestock pens housing 9 Hogs total with no water or container, three livestock pens housing a total of 17 Hogs with no water only dry containers, and five hogs were found in the outside livestock unloading area with no water or container. A Regulatory Control Action was taken as per 9 CFR 500.2 (a)(4), inhumane handling or slaughter of livestock. U.S. Reject Tag # B35 688655 was applied at the knocking pen area to indicate the rejection of the Livestock Barn and unloading area. Immediately informed Mr. [redacted] slaughter supervisor verbally of the noncompliance with 9 CFR 313.2(e) which requires that water be available at all times, and that animals held longer than 24 hours have access to feed and of the regulatory control action taken. Plant personnel were informed of the regulatory control action taken and that the regulatory control action will remain in place until the establishment implements the appropriate immediate and further preventive actions that ensure compliance with 9 CFR part 313.2(e). The Establishment Vice President, Mr. [redacted] was additionally informed verbally and in writing with this Noncompliance Record. The Establishment had taken immediate corrective actions of providing water to all livestock. At approx. 0920 hours Mr. [redacted] Plant Vice President responded verbally with preventive measures to help ensure water is available to livestock at all times. After verification of the Plants Immediate Corrective Actions and discussing the Plants proposed Preventive Measures the Regulatory Control Action (U.S. Reject Tag) was removed at approx. 0925 hours.


313.2(e) Animals shall have access to water in all holding pens and, if held longer than 24 hours, access to feed. There shall be sufficient room in the holding pen for animals held overnight to lie down.
