Citation: At 0705 hours while performing the 06D01 procedure in the processing room area of the establishment the following noncompliance was observed. Rust was observed to be starting to form on the non food contact side of the grinder which covers the electric motor. Also rust was starting to form on the fan/vent shield on the ceiling in the same area as the grinder. Mr. was notified verbally of these issues. No product was retained due to this noncompliance. 9 CFR 416.2(b)(1) states "Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions." No similar noncompliances were recently documented.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(1) Construction. (1) Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.
