Citation: On 12/8/10, at approximately 1000, while performing a scheduled 06D01, the following 06D02 non-compliance was found. The gut cart used as an inspection station has a rusty castor, rusty wheels, and rusty frame work. The wheel on the castor has been worn flat on one side and no longer works. The two main wheels of the cart have no bearings, making the cart unstable. Since this is an inspection station, US Rejected tag #B32675779 was applied to the cart because of the unstable condition of the cart. This is a violation of 416.2(b)(1), "Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions," and 416.4(b) "Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product." Review of records indicates that there are no other noncompliances of this nature in the last 60 days. Mr. [redacted] was notified verbally and in writing of the above noncompliances.

Regulation:

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
