Citation: On 7/14/2010 at 7:30 a.m., the establishment indicated they were ready for pre-operational inspection. While performing a scheduled 01B02, the following deficiencies were found. A sharpening steel had rust on it near the handle, and there were several lugs used for packaged product that were dirty with dirt, debris, and residue. The grinder had surface rust on the cutting blade and the grinder plate, and there were fat particles in the auger throat. US Rejected tag B18 896942 was applied to the grinder, steel, and lugs. When represented for inspection, I found a brown grease-like residue in the auger unit and housing where the throat attaches to the grinder. After a second inspection, the items were clean and released back the establishment. Mr. [redacted] was notified that this is a violation of 416.13(c) "Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP's," and 416.4(b) "Non-food contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product." Review of past records indicate that there are no similar NR's of this nature in the last 60 days. This NR serves as written notice that your failure to comply with regulatory requirements could result in additional regulatory and/or administrative actions. You are hereby notified of your right to appeal this decision as delineated by 306.5 and/or 381.35 of 9CFR.

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOPís.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
