Citation: At approximately 0800 on 7/13/10, while performing a general walk-through of the plant prior to resuming operations after a suspension, the following deficiency was found. On a rack in the corner of the storage cooler across from the processing room entrance, there were four covered grey lugs of unlabeled meat products, one of which was off-condition and had a pungent odor. The lugs were tagged with US Retained # B32675605. Mr. [redacted] labeled three of the lugs with hand-written labels, and disposed of the contents of the fourth. This is a violation of 317.1(a), "When, in an official establishment, any inspected and passed product is placed in any receptacle or covering constituting an immediate container, there shall be affixed to such container a label as described in 317.2." No similar NRs were found within the last 60 days. Mr. [redacted] was notified verbally and in writing with this NR that failure to comply with regulatory requirements could result in additional administrative and/or regulatory action. Mr. [redacted] was also notified of his right to appeal under 9 CFR 306.5.

Regulation:

317.1(a) No official inspection legend or other official mark which has been previously used shall be used again for the identification of any product, except as provided for in paragraph (b) of this section.
