Citation: While Performing a scheduled 01B02 at 7:15 a.m. on 6/24/2010, the following 06D01 noncompliance was found. In the raw cooler to the left of the door to the processing room there is condensation dripping from the ceiling on to a lug of 12 cry-o-vac lamb rumps. The lug was tagged with U.S. Retained tag # B32675604. Also, there is condensation on the top of the door frame going to the processing room. This is a violation of 416.2 "Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated," 416.2(b) "Construction. (1) Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions," and 416.2(d) "Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided." A check of plant records revealed there are several noncompliances relating to condensation in the cooler and that management is working on the problem, but has not been able to correct the situation to date. The product was removed from the cry-o-vac packages and put in new cry-o-vac packages and released. Mr. [redacted] was notified that this NR serves as written notice that your failure to comply with regulatory requirements could result in additional regulatory and/or administrative actions. You are hereby notified of your right to appeal this decision as delineated by 306.5 and/or 381.35 of 9CFR Past Similar NRs - Previous Ineffective Plant Actions: No response from plant at this time. Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(1) Construction.
