Citation: On 05/18/2010, a Routine Listeria monocytogenes (RLm) sampling was performed by Mr. [redacted] EIAO at Jamison Packing Company, Est. 9958 during a comprehensive food safety assessment (CFSA). The (RLM) sampling consisted of one sets for a very small establishment; 10 Food Contact Surfaces (FCS) samples; (RLMCONT), 5 composited environmental (non-FCS) samples; (RLMENVR) and 3 RTE product samples; (RLMPROD), were all taken in the Ready-To Eat (RTE) packaging room. 18 samples were submitted to the Western Laboratory in Alameda, Ca. on 05/18/2010, for analysis. On 05/21/2010, laboratory analysis results indicated the 10 FCS, and 3 product samples s were negative for Listeria monocytogenes (Lm). The (non-FCS) composites environmental sample received a presumptive notification on 05/22/2010, environmental (non-FCS) sample i.e. (Multivac control knobs, table leg in standing water, cooler door handle, RTE cart wheels and underside of floor drain), FSIS form number 11441767. Initial analytical steps (i.e. presumptive positive) indicated the strong possibility that the organism or toxin in question is present. Additional analytical steps were performed to confirm the presence or absence of the organism or toxin. On 05/26/2010, the laboratory confirms a positive, not acceptable (Lm) result. As per FSIS Directive 10, 240.5 if a post-lethality exposed RTE environmental (non-food contact) surface sample collected by the EIAO test positive for (Lm), this may indicate that product was produced under insanitary conditions. On 05/26/08, Plant Management was notified verbally by Mr. [redacted] and Mr. [redacted] CSI/IIC of the confirmed positive environmental (Lm) result. Furthermore, this document serves as written notification that failure to implement and immediate/ corrective actions and further planned/preventative actions may result in this agency initiating further enforcement actions at this establishment as described in 9 CFR 500.4. Also, you are hereby advised of your right to appeal this decision as delineated by 306.5 and/or 381.35 9 CFR.


416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
