Citation: On 6/24/2010 while performing a scheduled 01B02 the following 06D01 noncompliance was observed. On entering the raw product cooler there is a four shelf rack on the south wall, on the top shelf there is two boxes of packaged lamb that is directly over a lug of exposed offal meat. This is a possible source of contamination and management was notified immediately. Since management chose to discard the exposed product no enforcement tag was placed on the product. This is a violation of 416.1"Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated," and 416.4(d) "Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments." Mr. [redacted] was notified that this NR serves as written notice that your failure to comply with regulatory requirements could result in additional regulatory and/or administrative actions. You are hereby notified of your right to appeal this decision as delineated by 306.5 and/or 381.35 of 9CFR No other NR's of this nature were found in the last 60 days.
416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.
416.4(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.
