Citation: At approximately 1235 hours, while I performing the SPS review and observation procedure, in order verifies that the establishment was meeting the regulatory requirements of 416. The following non-compliance was observed in the shipping/box storage area: I observed numerous amount of rodent droppings in the corner of the room adjacent to the door of the ladies bathroom, also between the ladies and mans bathroom behind the skid of stored boxes. I immediately took regulatory control action by applying US Rejected Tag#B34782604, #B37853374, #B37853373 to the three skids of product shipping boxes. Establishment management Mr. has received oral and written communication concerning this noncompliance. This document serves as a written notification that your failure to comply with regulatory requirement could result in addition enforcement action as described in 9 CFR part 500. [newline]This is a failure to comply with the following regulations: [newline]9 CFR 416.1 General rules which clearly states: Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated. [64 FR 56417, Oct. 20, 1999] [newline]9 CFR 416.2(a) which clearly states: Grounds and pest control. The grounds about an establishment must be maintained to prevent conditions that could lead to insanitary conditions, adulteration of product, or interfere with inspection by FSIS program employees. Establishments must have in place a pest management program to prevent the harborage and breeding of pests on the grounds and within establishment facilities. Pest control substances used must be safe and effective under the conditions of use and not be applied or stored in a manner that will result in the adulteration of product or the creation of insanitary conditions.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(a) Grounds and pest control. The grounds about an establishment must be maintained to prevent conditions that could lead to insanitary conditions, adulteration of product, or interfere with inspection by FSIS program employees.
