Citation: On Tuesday, April 24, 2012 I was doing a record review for Heat Treated Not Fully Cooked product. [newline]I was reviewing the Bologna HACCP records from the beginning of the year (12 records) found the following deficiencies: 1) the dates do not have any years in them; 2) there is no monthly direct observation listed; 3) there is only one (1) monthly records review and that one is not properly filled out (no results, no time, no date); 4) there are no pre shipment reviews indicated. [newline]Your have failed your own HACCP Plan for the Heat Treated Not Fully Cooked Product for both CCP [redacted] that are not being done as indicated in your plan. [newline]This is a violation of the USDA Regulations 9 CFR 417.4(a)(2)(i), 9 CFR 417.4(a)(2)(ii), and 9 CFR 417.5(c). [newline]You have the right to appeal this decision based on 9 CFR 306.5 and 9 CFR 381.35. [newline]This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additonal regulatory or administrative action(s).

Regulation:

417.4(a)(2)(ii) Ongoing verification activities. Ongoing verification activities include, but are not limited to: Direct observations of monitoring activities and corrective actions; and

417.5(c) Prior to shipping product, the establishment shall review the records associated with the production of that product, documented in accordance with this section, to ensure completeness, including the determination that all critical limits were met and, if appropriate, corrective actions were taken, including the proper disposition of product. Where practicable, this review shall be conducted, dated, and signed by an individual who did not produce the record(s), preferably by someone trained in accordance with 417.7 of this part, or the responsible establishment official.
