Citation: On Friday, January 21, 2011 at approximately 0630 hours I was performing PBIS task 06D01, verifying facilities and equipment standards. I observed in the slaughter floor area that the walls contained unidentifiable foreign material (UFM) consisting of particles that ranged from specks of 1/32" to 1/16" near where the cooler doors are located. There was no product contamination observed. This is a violation of SPS standards because there is no indication noted on your SPS for this day. It is also a violation of 9 CFR 416.2(b)(2) where it states that you must "clean and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions." (copy attached). You have the right to appeal this decision based on 9 CRF 306.5 and/or 9 CFR 381.35. This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.

Regulation:

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.
