Citation: At approximately 0735 while reviewing the previous weeks records for another process; I found noncompliance with the Raw Not Ground Process records. On SMI Form -006, there was nothing listed under this process and under the Verification Form- 011 they document " No Product" under this process category. However, on Friday 08/06/2010 they produced chip steak because I came in on the end of its production and checked the CCP limits were met at the end of its processing. After the review of these records, I notified [redacted] of my findings and that this was a noncompliance. The establishment has failed to monitor the ' Raw Not Ground' process. Therefore not properly implementing their HACCP Plan for this process. A regulatory control action was not necessary at this time because the establishment has produced past history records and the fact that the CCP was met by my own hands on verification. The product was still on the premises and was checked once more today. The direct observation requirement was fine because under this Plan [redacted]. The establishment has records of direct observations documented for their ' Raw Ground' process. The establishment has failed to comply with the regulatory requirements listed under 9 CFR 417.2(e) and 417.5(a)(3).
417.2(e) Pursuant to 21 U.S.C. 456, 463, 608, and 621, the failure of an establishment to develop and implement a HACCP plan that complies with this section, or to operate in accordance with the requirements of this part, may render the products produced under those conditions adulterated.
417.5(a)(3) Records documenting the monitoring of CCP’s and their critical limits, including the recording of actual times, temperatures, or other quantifiable values, as prescribed in the establishment’s HACCP plan; the calibration of process-monitoring instruments; corrective actions, including all actions taken in response to a deviation; verification procedures and results; product code(s), product name or identity, or slaughter production lot. Each of these records shall include the date the record was made.
