Citation: During the Food Safety Analysis conducted by Dr. [redacted] the following observations were made: Heat Treat Not Fully Cooked Not Shelf Stable plan: The Heat Treated Not Fully Cooked Not Shelf Stable hazard analysis fails to offer supporting documentation at any process step as to why the (B) hazard Trichinella spiralis is not recognized as a hazard for raw pork. This is a noncompliance of 9 CFR 417.2(c)(1) and 417.5(a)(1). You have the right to appeal this decision as delineated by 9 CFR 306.5 and/or 9 CFR 381.35. This docment serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action(s).

Regulation:

417.2(c)(1) The contents of the HACCP plan. The HACCP plan shall, at a minimum: List the food safety hazards identified in accordance with paragraph (a) of this section, which must be controlled for each process.

417.5(a)(1) The establishment shall maintain the following records documenting the establishment’s HACCP plan: The written hazard analysis prescribed in § 417.2(a) of this part, including all supporting documentation;
