Citation: At 06:15 while performing pre-operational inspection on the slaughter floor after the plant had completed their pre-operational inspection he following non-compliance was observed. The loose molding on the upper left side of the cooler door in the drip room has not been repaired. This was reported on NR no. KCE2107121601N/1, dated 12/1/2011. Two of the inedible barrels on the slaughter floor are not marked inedible. This is a violation of 9CFR 416.2(b) (1) and (2) which state in part “Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair…” and 9CFR416.3(c) which states in part, “ Receptacles used for storage of inedible material …must bear conspicuous and distinctive marking to identify permitted uses.” [redacted] was notified of these noncompliances. This NR is linked to the NR cited above as the preventive measures or further planned actions were either ineffective or not implemented. This document serves as written notification that your failure to comply with regulatory requirements could result in additional regulatory or administrative actions. Mr. [redacted] is also advised of his right to appeal this NR as delineated in 9 CFR 306.5.

Regulation:

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.

416.3(c) Receptacles used for storing inedible material must be of such material and construction that their use will not result in the adulteration of any edible product or in the creation of insanitary conditions. Such receptacles must not be used for storing any edible product and must bear conspicuous and distinctive marking to identify permitted uses.
