Citation: February 24, 2011 16:00 hours While performing a scheduled general labeling, 04B04, inspection procedure in the tray pack room, I observed bone-in chicken thighs being prepared and packaged in their immediate, retail containers and labeled with the term "Thighs." Upon examining four (4) pieces of this cut product, I noted that a portion of the split backbone approximately three (3) inches in length was intact in each. I immediately informed QC/HACCP manager, Mr. [redacted] of my findings verbally. At approximately 16:20 hours, I returned to the tray pack room to verify the plant's corrective actions properly addressed this noncompliance by either relabeling product appropriately according to its standard of identity, "thigh quarters" or "bone-in thigh with back portion" in this instance, or removing the ilium bone, I discovered that management had failed to maintain control of the affected product and that it had been moved to the shipping dock where it was on the verge of being loaded onto a waiting truck. I retained two cases of the untrimmed product still bearing the erroneous term "Thighs" on both the immediate, retail and shipping container labeling by affixing the Food Safety and Inspection Service Form 6502-1 #B39133083. This is a failure to comply with the United States Code of Federal Regulations, Title 9, Chapter III, Animals and Animal Products, Section 381.170(b)(5) and the United States Department of Agriculture's Agricultural Marketing Service's "U.S. Trade Descriptions for Poultry," (August 2000). Mr. [redacted] was promptly notified of the noncompliance verbally. This document serves as written notification that failure to comply with regulatory requirements may result in additional regulatory and/or administrative action(s).

Regulation:

381.17 Every application for inspection at any establishment shall be made by the operator on a form furnished by the Meat and Poultry Inspection Program, Food Safety and Inspection Service, U.S. Department of Agriculture, Washington, DC 20250, and shall include all information called for by that form, including the name of any subsidiary corporation that will prepare any poultry product or conduct any other operation at the establishment for which inspection is requested. The applicant for inspection will be held responsible for compliance by all its subsidiaries with the requirements of the regulations at such establishments if inspection is granted. Processing of poultry products and other operations at the establishment for which inspection is granted may be conducted only by the applicant, except that such a subsidiary of the grantee, may conduct such operations at such establishment.
