Citation: Tonight at approximately 1940 hour, I observed 2 workers picked up the chicken parts from the dirty wet floor and put the picked up chicken parts into the 2 different containers containing cleaned chicken part products located by the chicken parts transporting belt inside the operating poultry processing room. I tagged that 2 containers with the U.S. RETAINED/REJECTED tag # B39718924. The processing manager Mr. [redacted] was not at the scene at the moment. I called a worker to find him for me while I was still standing by the 2 tagged containers to make sure no one comes to move the boxes away before Mr. [redacted] was notified and shown of the noncompliance. After Mr. [redacted] was notified and shown of the noncompliance, he explained that one of the 2 workers was a new worker of the plant. I spent approximately 45 minutes watching one designated worker performing the corrective action by the "Product Washing Sink" as the plant's SSOP specified. He was rinsing all the adulterated chicken parts piece by piece in that tagged containers. After the 2 tagged containers were emptied, and I observed that one container(plastic) was fully sanitized for re-use, and the another container(chicken box) was put into the garbage tank, the tag # B39718924 was detached by me. Plant's SSOP-Operational Inspection-Monitoring states: [redacted]. -Failure to meet the federal regulatory requirement of the 9 CFR 416.13(c) which states: Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP's. -Failure to meet the federal regulatory requirement of the 9 CFR 416.4(a) which states: All food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product. -Failure to meet the federal regulatory requirement of the 9 CFR 416.4(d) which states: Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments. This document serves as written notification that failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
