Citation: On this day at approximately 2030 hours time after I had finished reviewing the plant's Operational Checklist-Processing which shown all processing areas were check-marked acceptable at the time 7:25pm as indicated on the Operational Checklist-Processing work sheet by the processing manager Mr. [redacted] I went to the poultry packing room to perform my verification procedure 01C02, and I observed water beads dripping down from an overhead cooling-unit-pipe to the exposed raw chicken legs product on the boning table located below the overhead cooling-unit-pipe. I tagged the exposed chicken legs product with the U.S.Retained tag # B38600537 and I immediately notified and shown the plant's processing manager Mr. [redacted] of the noncompliance. I also observed water beads dripping from another cooling unit in the same packing room. Condensation was observed. Finally I observed a worker [redacted] as the plant's SSOP Corrective Action procedure indicated in the plant's SSOP and found acceptable. I removed the tag. Plant's SSOP-Monitoring(1) page 6 states: [redacted]. Failure to meet the federal regulative requirement of the 9CFR 416.13(c) which states: Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP's. Failure to meet the federal regulatory requirement of the 9CFR 416.2(d) which states: Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided. Failure to comply with the federal regulatory requirements may result in further regulatory and/or administrative action(s). Past Similar NRs - Previous Ineffective Plant Actions: This NR has not been responded and returned yet. NR: 47-2010 dated 6/24/2010

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOPís.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.
