Citation: On October 24, 2011, I observed the following in the eviscerating/processing room. (1) At 0720 hours, an employee was packing giblets into a brown shipping bag placed directly on the floor which was wet. I immediately stopped the operation, and took the regulatory control action (U.S. Retain Tag #B38033421) to restrict the use of the affected products until corrective action could be performed. (2) At 0725 hours,chicken liver kept in a perforated container (half filled with liver) was left on top of an upside-down trash bin; that is, bottom surface of the trash bin was in direct contact with the perforated container with edible product in it. An U.S. Retain Tag (#B38033422) was applied to the affected product until corrective action could be performed. Both evidence was shown to the floor supervisor, [redacted] This is a noncompliance with Regulation 9CFR 416.4(d) and 416.13(c). Continued failure to meet regulatory requirements would lead to further enforcement actions.

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOPís.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
