Citation: On October 4, 2011, at approximately 0625 hours, I observed the kill room area and the following was noted : (1) Protective cover of the light in the ceiling has green moldy material and quite some moisture built up inside; (2) Red peeling paint was observed on the overhead beam of the entrance door to the kill room from the hallway. Both evidence was shown to floor supervisor, [redacted] No product was involved. This is in noncompliance with 9CFR 416.2 (b)(1) which states "Establishment buildings, including their structure, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions." Continued failure to meet regulatory requirements would lead to further enforcement actions.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(1) Construction. Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.
