Citation: At approximately 8:05 performing operational sanitation in cut up room observed employee using the pallet jack to move boxed product, pallet jack was leaking a brownish, greenish looking fluid onto to cut up room floor in back part of room. Production was being conduct during the observation. Production immediately stopped and machine rejected with U.S. Reject Tag # B35500369 and Mr. [redacted] Processing Manager verbally informed of non-compliance and 9CFR 416.1 and 416.2(b)(2). Machine was removed from area and repaired and floor was wash and sanitized prior to starting operation. U.S.Reject Tag remove by FSIS Inspector. This document serves as written notification that failure to comply with regulatory requirements could result in additional regulatory or administrative action(s).

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.

416.6 When an FSIS program employee finds that any equipment, utensil, room, or compartment at an official establishment is insanitary or that its use could cause the adulteration of product, he will attach to it a ‘‘U.S. Rejected’’ tag. Equipment, utensils, rooms, or compartments so tagged cannot be used until made acceptable. Only an FSIS program employee may remove a ‘‘U.S. Rejected’’ tag.
