Violation:  381.65(b)

Citation: On 8/24/11 at approximately 1500 hrs while performing a scheduled 04C04 procedure and ante-mortem examination the following non-compliance was observed: The area around one of the tractor trailers was not checked for loose birds prior to it being moved forward in the bay. This resulted in the crushing death of one bird who was just in front of one of the rear wheels of the vehicle. When this was observed, I immediately shouted for the truck to be stopped and all birds removed prior to any additional vehicle movement. The truck was immediately stopped however no personnel were dispatched to remove the remaining birds on the floor and the vehicle was then started up in reverse, almost resulting in the crush deaths of 3 more birds (which was avoided by myself shooing the birds out from under the wheels). on the kill floor, and were immediately notified of the non-compliance and violation of the Good Commercial Practices for poultry and was informed that an NR would be issued. This failure to follow good commercial practices is in violation of 9 CFR 381.65(b) This document serves as written notification that your failure to comply with regulatory requirements could result in additional regulatory or administrative action.

Regulation:

381.65(b) Poultry must be slaughtered in accordance with good commercial practices in a manner that will result in thorough bleeding of the carcasses and ensure that breathing has stopped prior to scalding. Blood from the killing operation must be confined to a relatively small area.
