Citation: Approximately 2040 hours I observed the following while performing a scheduled 01C02 procedure task, fully exposed raw ready to cook chicken legs are defrosting in direct contact with continuously flowing water inside two plastic vats in the Defrosting Room of the establishment. Review of the establishments Protocol For Evaluating Retained Water on file does not include or factor additional water absorption/ retention from their defrosting in water process in which [redacted]. The chicken products contained within the two vats started chilling at 0910 and 0915 hours as marked on the outside of the vats which is approximately 11.5 hours of submersion from start of the process to the time of observation. At this time no documentation demonstrating a negative or zero gain in water can be presented or is available on file related to this defrosting in water process. Two vats of chicken legs, approximately 2,000 lbs total or 1,000 lbs each vat retained with US Retained tag 19 929045 and B 19 929044. This is a failure to meet 9CFR 441.10 and 9CFR 381.65(c). I verbally notified Second Shift Processing Manager, Quality Control (QC), and Quality Control (QC), of the non-compliance. This serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.

Regulation:

441.1(a) Raw livestock and poultry carcasses and parts will not be permitted to retain water resulting from postevisceration processing unless the establishment preparing those carcasses and parts demonstrates to FSIS, with data collected in accordance with a written protocol, that any water retained in the carcasses or parts is an unavoidable consequence of the process used to meet applicable food safety requirements.
