Citation: At approximately 0945 hours a empty rack was observed being brought on to the kill floor. The rack was going to be used to hold gray totes containing hearts and livers from the ovine slaughter being conducted on the kill floor. The rack was observed to have product residue on it from a previous use. USDA REJECT TAG # B 21204394 was applied to the rack and Mr. was informed of my observation and action taken with the rack. No product was affected as the observation and action taken was done before the rack was used to store product This a failure to comply with regulations 9 CFR 416.1 and 416.4(b) This document serves as written notification that your failure to comply with regulatory requirements could result in additional regulatory or administrative action

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
